Under the Indian Patents Act, 1970, a Patent is issued for twenty years from the filing date of the Convention or Ordinary Application. However, for Patent applications entering the national phase in India through the PCT route, the term of Patent is estimated from the filing date of the international application, provided that the renewal fee is paid every year before the due date or within the extended time of maximum six months.
